When both parties agree to all issues pertaining to a divorce, they may file for an uncontested divorce.

Do I Need a Lawyer for an Uncontested Divorce?

Also referred to as a “Desk Divorce” an uncontested divorce is most common when a Separation Agreement covering all issues was in place, or if there are no issues of child custody, support or division of property.

You likely already worked with a family law lawyer for your Separation Agreement and may not need a divorce lawyer for an uncontested divorce. If you have not worked with a lawyer to establish your Separation Agreement, if you have any issues that you have not come to an agreement on, or if you have children, assets, or support that needs to be agreed upon and filed, you may not be able to file for an uncontested divorce. In these cases it is strongly recommended that you seek legal advice from a family law lawyer to ensure that you’ve done your due diligence that is protecting you and your family.
